Air Prishtina AG is a tour operator. The transportation contract between the passenger and Air Prishtina AG is subject to applicable laws and the terms and conditions shown here. The liability of airlines is subject to the Montreal/Warsaw Convention or the EC Regulation 2027/97.
1. Booking terms
1.1 At Air Prishtina AG the booking can be made online (www.airprishtina.com), through travel agencies or via the call center. Upon all bookings made via the call center of Air Prishtina AG, the passenger receives a booking code per email, SMS or via phone depending on the type of reservation. The confirmation contains the booking number, the name of the passenger, flight information and remarks.
1.2 Air Prishtina AG considers the booking as accepted at the time the passenger receives the booking confirmation per email or SMS. In the event of sales via phone through the call center, the declaration of acceptance can be done formlessly or through concludent behaviour (the vocal transmission of the booking code).
1.3 The passenger is obliged to verify the correctness of the transmitted reservation data and, if necessary, immediately point out any incorrectness, discrepancy or lack of delivery. Delayed reference to incorrectness or discrepancy does not give rise to a withdrawal of the contract.
1.4 The services and the ticket fare confirmed at the time of reservation are final and binding. The ticket fares on our website (www.airprishtina.com) are subject to ongoing adjustments and can fluctuate up and downwards. Special and discounted offers are subject to alteration.
1.5 The transportation will be granted only upon presentation of complete and valid travel documents (Passport, ID card, confirmation codes, visa etc.). The passenger himself is responsible for adherence to the rules and regulations that govern his journey. Refund claims that come as a result of denied boarding due to non-compliance with the entry and exit regulations are not accepted.
1.6 If the passenger is denied entry into a certain country, he/she will bear all expenses incurred for his return from that country. The ticket fare to the point where entry was denied will not be refunded to the passenger.
1.7 Reservations must be made under the name of the passenger who intends to fly. If this is not the case, carriage cannot be provided to that passenger. In such cases, the ticket is non-refundable
1.8 Generally, children younger than 12 years will be carried only if accompanied by an adult guardian. Air Prishtina AG must be notified of unaccompanied minors at least 48 hours before departure, otherwise the transportation is not guaranteed. In these cases, supervision services must be booked with the airline and handling agents. It should be noted that, in some countries, children under the age of 18 must present a completed authorization form from their guardians in order to leave their home country. Passengers are responsible for compliance with these requirements. Noncompliance is in breach of travel regulations, which will lead to the passenger being excluded from reimbursement if the airline cannot accommodate them.
1.9 Transportation of small children (up to 2 years) must be registered. The determining factor is the child's age at the time of the flight. When booking round-trip flights, it depends upon the age when the returning flight departs.
1.10 Connections to onward flights are not guaranteed.
1.11 The flight reservations of return flights must be confirmed in the Contact Center of Air Prishtina AG at least 48 hours before the flight. The failure to confirm may result in cancellation of the flight reservation. A return flight to the scheduled destination airport is not warranted under the circumstances, and may be subjected to the prior payment of an extra fee, if there are still places available on given flight.
2. Payment
The flight times booked at Air Prishtina AG can be purchased on credit cards that are accepted by Air Prishtina AG or through bank transfer. Further, the purchase can be completed on cash terms at one of the office of Air Prishtina AG partners or at the airport desks of Air Prishtina AG.
2.1 Payment with credit card
It is up to the customer to provide a valid, genuine, complete and, in what so ever form, a non-manipulated card to Air Prishtina AG. If this is not the case, Air Prishtina cannot guarantee the price or the booking as such. In such cases Air Prishtina AG reserves the right to employ a collection agency with the collection of receivables. In the event of unwillingness or inability to pay, the default will be reported to the relevant companies or governmental organizations (credit bureau, enforcement agencies etc.)
2.2 Payment through bank transfer
Payment default or late payment entitles Air Prishtina AG to deny provision of any service especially passenger carriage. In addition, in such cases Air Prishtina AG is entitled to hire a debt collection agency for the purpose of debt collection. In the event of unwillingness or inability to pay, the default will be reported to the relevant companies or governmental organizations (credit bureau, enforcement agencies etc.)
2.3 Payment on invoice
2.3.1 In case of payment by invoice, the invoice amount is due on the payment date specified on the invoice (14 calendar days after the invoice date) to the account specified on the invoice. The payment method “by invoice” requires a successful credit check by the BillPay GmbH, possibly as service provider of a Factor cooperating with Billpay. The result of this check only affects the payment, not the booking itself. Air Prishtina AG reserves the right not to accept the payment method “by invoice” for certain bookings and instead redirect the user to other methods such as payment with credit card or via bank transfer.
2.3.2 The method of payment “by invoice” on account requires the consent of the transfer of data necessary for the processing of payment as well as identity and credit rating data (first and last name, address, birth date, phone number) to BillPay and possibly to Factors cooperating with BillPay. The use of these data takes place only when the payment method “by invoice” is selected, otherwise the data will automatically expire after 30 minutes.
2.3.3 Failure to meet the payment obligation leads to default without further reminder. In this case, a default interest of 10% per year is due. The proceedings are being carried out by Billpay GmbH, or in certain cases commissioned by Factors cooperating with BillPay, which are entitled at every payment reminder to charge up to EUR 15.00, and other fees, in particular the cost of a possible debt collection process or costs of a lawyer assigned with the collection. The assertion of further rights and claims remains unaffected. Furthermore BillPay can refuse to process the payment of sales contracts, even in relation to other traders. All terms and conditions of the BillPay GmbH apply.
3. Reservation change, name change and cancellation
3.1 Booking changes can be made up to 48 hours before departure for a fee of EUR 20.- or CHF 30.- per passenger, subject to availability of seats at the respective tariff. Additional charges can occur in case of a difference in fares. In case of rebooking into a lower fare, the original fare will apply.
3.2 Name changes can be made up to 48 hours before scheduled departure. Additional costs are determined by the applicable fare for the given route at the time of the name change. If the fare applicable at the time of the passenger change for given route is higher than the fare of original booking, the difference must be paid. Reimbursement of any deficiency in the amount, however, is excluded.
3.3 Passengers are required to take both outbound and inbound flights. If the outbound flight is not taken, the inbound flight will be automatically canceled and the refund of ticket fare excluded. This applies also if the return flight is not taken.
3.4 The passenger has the right to withdraw from the trip at any time before flight commencement (cancellation). The time of receiving the booking cancellation by Air Prishtina is crucial. An explanatory statement by registered mail is recommended. Refund after departure is not permitted.
The cancellation charges are calculated as follows:
from the 9th to the 5th day prior to departure 25% of the ticket price,
from the 4th day until 2 days prior to departure 50% of the ticket price,
form 1 day before to the day of departure 100% of the ticket price.
The passenger is recommended to obtain insurance cover.
The refund of the ticket price will be made exclusively in form of a value voucher, regardless of the payment method. The value voucher is valid for six months after the date of its issuance. The voucher has no value if not honoured within the validity period.
3.5 The limited offers quoted at a ticket fare below CHF 100 or EUR 80 (one-way flight inclusive fees and charges) are neither changeable nor refundable.
3.6 The charges and fees imposed by Air Prishtina AG are subject to change at any time. This concerns charges for booking via phone, payment by credit card, cancellation fee, rebooking fee or other charges or fees. The charges and fees can be reduced, increased or even waived.
4. Seating configuration
Passengers have the option -depending on availability on the airline- to book a certain standard seat or a VIP seat with more legroom (seats in the front row and exit seats) against a fee of CHF 10 / EUR 15 (Standard seating) or CHF 20 / EUR 15 (VIP seats) per passenger and flight based on availability. Air Prishtina AG, however, reserves the right to reconfigure the reserved seats again if required by the operating carrier for reasons of safety, etc. In these cases, Air Prishtina AG will refund the fee to the passenger.
5. Handling and delays
5.1 Travel documents and booking confirmation must be available at check-in.
5.2 Passengers should arrive at least 2 hours before departure at the airport check-in.
5.3 In case of late arrival, Air Prishtina AG reserves the right to cancel the reservation.
6. Luggage
Luggage conditions vary by airline. Conditions of relevant carriers apply. The regulations for hand luggage and the current safety regulations apply.
7. Personal information
The passenger allow Air Prishtina AG to collect, store and use his personal data (name, address, telephone number, email address) for purposes of reservation, fare payment, provision of data for the airlines, and to submit the data at offices of Air Prishtina AG to authorized representatives, credit card and bank card issuing institutes, trusted third parties and partners (BillPay GmbH, for the payment method “by invoice”), government agencies and subsequent carriers.
8. Baggage claim and luggage loss
The liability for passenger, baggage and cargo damage and damage due to delay, denied boarding and cancellation is governed by the provisions of the relevant carriers or the applicable law (such as the Montreal/Warsaw Convention or the EC Regulation 2027/97). Every complaint should be addressed to the operating airline in written form. The possible inclusion of a damage report at the airport or at Air Prishtina AG does not replace the timely written notice to the relevant carrier.
9. Flights
The passenger will be carried on a schedule or charter flights operated by a Swiss or other foreign airlines. The published flight schedule, the operating airline and/or the operating aircraft can be subject to short-term changes.

11. Use of the website
Information, products and services accessible on this website cannot be changed or used for derived works.
12. Acceptance of these terms and conditions (AGB / GTC)
The use of the website www.airprishtina.com and the herein offered services by Air Prishtina are subject to these General Terms and Conditions (GTC). By using this website you agree to these GTC without reservation, otherwise the usage by you of this website and of the services offered by airprishtina.com is not permitted.
13. Additional agreements
Additional agreements, extensions, modifications or other assurances to this contract are only applicable if confirmed in writing.
14. Applicable Law
The contract is subject to Swiss law. The place of jurisdiction is Zurich, Switzerland.
The German version of these General Terms and Conditions take priority over its translated versions.
15. Severibility clause
If one or more terms of this agreement are or become ineffective, the validity of other terms should not be affected.
16. Validity
These terms and conditions are valid as of 15.03.2013.
